Agent Terms
Version 2026-11-02. Effective November 2, 2026. All legal documents
These terms apply to every real estate agent on PitchToList, in addition to the Terms of Service.
The short version
Verification is free. Invitations, accepting and declining are free. You pay only when you submit a pitch: your first one is free, then a prepaid credit or $49 on your saved card. There is no subscription, and prepaid credits never expire. You get a pitch back automatically in the cases in section 12. Nothing you pay changes who is invited or anything a seller sees. Do not contact sellers outside PitchToList before they choose you.
1. Scope
These Agent Terms are part of the Terms of Service. Words defined there mean the same here. You accept them when you apply, and again whenever we publish a new version you are asked to accept.
If you join or declare a team, you accept these terms for yourself.
2. Eligibility and verification
To be invited or pitch you must be verified, which is the same for everyone and free:
- An active real estate license in good standing in the state where the home is located, checked with that state's licensing board. You are invited only to homes in the state of your license.
- A confirmed brokerage: confirmed by our team with the board's record, a call to your office or a letter from your managing broker.
- Good standing here: no removal and no open suspension on PitchToList.
Which spots you are drawn for depends on your closed sales, each checked against an MLS report or public record:
- The PitchToList bar: at least 10 closed sales in the last 12 months and at least 7 sold listings (listing side or both sides) in the last 24 months. Agents who meet it are drawn first.
- The standard bar: at least 3 closed sales in the last 12 months, including at least 1 sold listing. Agents who meet it fill the spots our bar can't.
- The new voice spot: up to 1 spot per home for any verified agent below our bar, through the same rotation, with the same terms, deadlines, form and price.
Only sales a person checks against an MLS production report or a public sold-history record count; a sale you win through PitchToList counts the same way once it is checked. Your standing is recomputed when your sales change and every day, and invitations already made are not affected. Sellers see your record, never your standing or which spot you hold, and nothing you pay changes it.
A fabricated sale or license means permanent removal.
We record each license check, re-check your license with your state's licensing board every 90 days and before it expires, and may suspend you automatically if the record shows it expired or inactive until a re-check passes. You must tell us within 5 business days if your license status changes, you change brokerage, or you become subject to disciplinary action.
Everyone who passes gets the same verified badge. It is never sold or tied to a plan.
Some people cannot be agents here, including the owner of the Service, and accounts that match the owner denylist are refused without saying why.
3. Your licensing duties
- Hold an active real estate license in good standing in the state where the home is located for as long as you use the Service, and act only within it.
- Act under the supervision of your principal or supervising broker, and make sure your brokerage's policies permit you to use the Service and to pay for it. You are responsible for any fee split, approval or record your brokerage requires.
- Follow the real estate license law and regulations of your state, including the rules on advertising, disclosure of your licensee status and brokerage, disclosure of any personal interest, conflicts of interest and improper dealing. A pitch, your profile and your messages may be advertising; make sure they meet those rules. We include your name, brokerage and license number on your full pitch for that reason, and your brokerage's office phone or website when you add it to your profile.
- Any listing agreement must be with your brokerage, on its forms, signed outside the Service. We do not draft or review agreements.
- Be honest. Never misrepresent your license, experience, sales, fees, services, team or any fact about a home or a transaction.
- Disclose any conflict in your pitch, for example if you or a relative may want to buy the home, or you represent a nearby competing listing.
4. No off-platform contact
You may contact a seller you found through PitchToList only through PitchToList's messaging until that seller chooses you, unless the seller first gives you their phone number or email in a message. You may not use anything you learn on PitchToList, including a shortlisted seller's address or name, to find, call, text, email, mail, visit or advertise to that seller or their neighbors outside PitchToList. If a seller shortlists you and does not choose you, you may not contact them again unless they contact you first. Violations, confirmed after we review the seller's report and your response, result in removal from PitchToList, forfeiture of any unused credits, and a ban on rejoining. We may also report conduct that appears to violate the real estate license law and regulations of your state to the appropriate authority.
Sellers can report a violation from every shortlisted pitch. We review reports within 2 business days, hear your side, and record every report and outcome.
5. Honest answers and commitments
- Every answer in your pitch must be true and written for that home.
- What you commit to (photos, staging, open houses, marketing, go-live days, updates) is a promise. Sellers who choose you rate whether you kept it.
- You can edit your pitch until your submit deadline or until final selection opens, whichever comes first; then it locks, and the commitments in it are kept as submitted. The seller may read it as soon as you submit it.
- No comps, suggested list price, price range or valuation anywhere on PitchToList, and no attachments.
- All fees are set by each agent and are negotiable.
- Do not discuss or coordinate fees with other agents. Each fee in a pitch must be set independently by you and your brokerage.
After a home stops collecting pitches, the seller may ask you to change a term in your pitch. You may accept, decline or offer different terms within the time shown. A change you accept is shown to the seller on your pitch, and a changed service commitment is what the seller may rate later. Asks and answers cost nothing and never affect invitations, your reliability or how pitches are shown. The listing agreement you and the seller sign is what controls.
Who sees your name
The seller reads your pitch on a card labeled with a letter (Agent A onward), shown in random order, with no name, brokerage or photo while any pitch on the home is still outstanding. Once no pitch is outstanding, that is, once all 5 pitches are in, or the home has stopped collecting pitches (the 72 hours after go-live for inviting agents ended, the seller stopped inviting, or no eligible agent was left) and no invited agent is still within their time to answer or their 24 hours to write, the seller sees your name, brokerage and photo with your pitch, whether or not they shortlist you. If they shortlist you, they can also open your full pitch, including your license number, and message you.
Other agents who pitched on the same home never see your name, brokerage, photo or pitch on PitchToList, and you never see theirs. If you are not shortlisted, you may get private feedback that says how many pitches the home received and where each of your own commitments placed among them, never another agent's identity or numbers. PitchToList does not tell you which agent the seller chose, but a home that is listed for sale is public, so you may learn it elsewhere.
6. Fair housing
You must follow the federal Fair Housing Act, applicable state and local fair housing laws, and the related real estate regulations of your state in everything you do on and off the Service for a seller you meet here. Do not steer, refuse to deal with, or treat a seller or a buyer differently based on a protected class, and do not include any discriminatory statement, preference or limitation in a pitch or message. See the Fair Housing Statement.
7. No referral payments
You may not pay or accept a referral fee, kickback or anything of value for referring any PitchToList seller, buyer or transaction, and PitchToList never pays or accepts one. What you pay us is a flat price for a software and advertising service actually provided: delivering your pitch to a seller. It is the same for every agent, does not depend on the home's price, your commission, the seller's choice or any closing, and is never refunded or increased because of a transaction's outcome.
8. Invitations
When a seller's home goes live, we invite up to 5 eligible verified agents to pitch, one per team. Each invitation holds one of the 5 spots. You are eligible for a home when it is in the state of your license, its area is in your service area and its property type fits your preferences, your invitations are not paused, and you are not suspended or on a billing hold.
- Agents who meet the PitchToList bar (10 sales in 12 months and 7 sold listings in 24, checked against records) are drawn first.
- Spots they can't fill go to agents who clear the standard bar (3 sales in 12 months, including 1 sold listing), and up to 1 of 5 on each home goes to a verified agent still building their record.
- Within each, invitations rotate among eligible verified agents whose service area and property preferences fit the home.
- Reliability counts: accepting and submitting on time helps, and missing a deadline you accepted can pause your invitations for a while. Declining never counts against you.
- We also mix up who competes with whom, so the same agents are not matched against each other on every home.
- Nothing you pay, buy or save changes who is invited, how often or when.
- Each home gets at most 5 competing pitches. Being invited is not a promise of any particular chance of being chosen.
Nothing below changes who is invited: your credit balance; any pack you buy; any payment to us, or whether you saved a card; your years licensed; your brokerage; the fee you offer; how fast you answer; how long you have been on the platform; seller ratings; how often you are shortlisted or chosen.
- You have 6 hours to accept or decline an invitation, counting only the hours from 8 AM to 9 PM in the home's local time (an invitation sent at 10 PM is due at 2 PM the next day). An invitation made overnight is emailed at 8 AM, the home's local time. Every time we show you about a home is in the home's local time.
- Accepting is free and starts your own submit window of 24 hours, shown as an exact deadline. Before you accept, we show the price and what will pay for the pitch (section 10).
- Declined, expired and withdrawn spots go to other agents for up to 72 hours after the home goes live. A home never has more than 5 pitches submitted and spots held combined.
- The seller may stop inviting at any time. Invitations you have not answered are then cancelled, with no effect on you; an invitation you accepted keeps your full window.
- You may hold at most 2 invitations at once that you have not answered or submitted.
- You can pause invitations from your dashboard at any time and turn them back on whenever you like.
Each allocation is seeded and logged so it can be replayed and audited.
When a choice falls through
If a seller's choice of agent falls through before the home is listed with that agent, within 30 days of the choice, the seller may choose again from the same pitches on that home; the chosen agent may also step back. Every other agent whose pitch is on the home is asked once, all the same way, whether their pitch still stands, with 24 hours to answer, counting only the hours from 8 AM to 9 PM in the home's local time. A pitch stands as you sent it, with only the changes you agreed with that seller, and nothing reopens writing or editing. Saying no, not answering, stepping back and a choice that ends never count against you: no strike, pause or change to how you are invited. No fee is charged or credited back because of any of it.
Calls and emails from our team
When a home is in an area with too few agents who meet our bars on PitchToList, our team may call or email local agents, including agents not yet on PitchToList, to invite them to join. Every call and email uses the same script, and every email has our mailing address and a link to stop further ones. Nothing is promised, and joining this way never gives priority for that home or any other: you join the same pool, under the same rules, as every other agent.
9. Reliability, strikes and pauses
- Declining an invitation is always free and never counts against you.
- Letting an invitation expire without an answer counts a little against your reliability. If 3 invitations in a row expire, your invitations are paused until you turn them back on.
- Withdrawing within 2 hours of accepting is free. Withdrawing later counts a little against your reliability but is not a strike.
- Accepting and then missing your submit deadline is a strike. 2 strikes within 90 days pause new invitations for 30 days. You keep your profile and submitted pitches.
- You can see your own reliability record on your reliability page.
10. Pricing
Always free
- Receiving and accepting invitations.
- Declining an invitation.
- Verification.
- The verified badge.
- Being shortlisted.
What you pay
You pay only when you submit a pitch, once per pitch. Editing a submitted pitch is free. Nothing is charged for receiving, accepting or declining an invitation, for withdrawing, or for being shortlisted or chosen.
How a pitch is paid for, in this order
- Your free intro pitch: every agent gets one free submitted pitch, one time ever, used first.
- A prepaid credit: the oldest one first.
- Your saved card: $49, plus any applicable tax, charged when you submit.
Prepaid packs
- 5 pitches for $225, paid once ($45 a pitch). The credits never expire.
- 10 pitches for $399, paid once ($39.90 a pitch). The credits never expire.
Packs are one-time payments, not subscriptions. Nothing renews.
Credits
- Prepaid credits never expire.
- Credits have no cash value, cannot be transferred or sold, and are not refundable except as stated in section 12.
- Credits prepay pitches only.
Before you accept
Accepting is free, but you can accept only when the pitch can be paid for: by your intro pitch or a credit (enough for every invitation you have accepted and not yet submitted), or by a saved card. Otherwise we show the price and ask you to save a card or buy a pack first.
Never
- No subscription.
- No closing fee, ever.
- No referral fee, in or out.
- No selection fee when a seller chooses you.
- No charge when a seller shortlists you.
- No percentage of your commission.
- Paying never buys invitations, more or earlier invitations, placement, ranking, card layout, a badge or your standing.
We may change the price per pitch and the packs with at least 30 days' notice by email. A change never takes away credits you already hold or changes the price of a pitch you accepted before the change.
11. Your saved card
When you save a card, you authorize PitchToList to charge it $49, plus any applicable tax, each time you submit a pitch with no intro pitch or credit left. It is not a subscription and nothing is charged for saving it. Remove the card any time on the Billing page.
We record that authorization with the date and time. Each charge produces a receipt you can open from your billing page.
You cannot remove the card while it is the only way to pay for an invitation you accepted; submit or withdraw that invitation first, or buy a pack.
12. Credit-backs and refunds
A submitted pitch is credited back automatically, once, if:
- the seller never opens your pitch within 7 days of final selection opening;
- the seller cancels the home before final selection opens (a cancel after final selection opens does not qualify); or
- we verify the home was fake or a duplicate and remove it.
What comes back is what paid: the intro pitch comes back as your intro pitch, a credit comes back as a credit, and a card charge is refunded to the card. Losing the listing never qualifies, and nothing comes back because of whom the seller chooses or whether they choose anyone: the seller chose another agent, chose no one, hired someone else or is not selling.
Otherwise purchases are final and credits are not refundable, except for duplicate or mistaken charges, a charge we made in error, or where the law requires a refund. Write to support@pitchtolist.com within 60 days of a charge you believe is wrong; we will look into it and refund any error to the card that paid. A refund takes back the credits that purchase added, in proportion, rounded in your favor.
13. Declined cards and billing holds
If your card is declined when you submit, the pitch is not submitted and nothing is charged. The card stops counting as saved, and you can save a working card or buy a pack and submit again before your deadline; the deadline does not move. A charge from an earlier version of these terms that is still unpaid places a billing hold (no invitations) until it is paid.
14. Chargebacks and payment disputes
Please contact support@pitchtolist.com before disputing a charge with your card issuer; most problems are fixed faster that way. If you open a dispute, the credits from that payment are taken back and you are placed on a billing hold (no invitations) while it is open. If the dispute closes in our favor, the credits come back and the hold lifts once nothing else is owed. If it closes in your favor, the hold stays until support reviews the account. Filing disputes for charges you authorized is a breach of these terms.
15. Taxes
Prices are in US dollars and do not include taxes unless stated. You are responsible for any sales, use or similar tax that applies to your purchase, which we will show before checkout if we are required to collect it, and for your own income taxes and business records.
16. Payment processing
Payments are processed by Stripe. By paying you also agree to Stripe's terms for that payment. We do not store full card numbers; we keep a customer reference, whether a card is saved, and payment records.
17. No guarantee of results
We do not promise any number of invitations, homes, pitches, shortlists, listings, sellers, leads or closed sales, any particular chance of being chosen, or that any seller will read, shortlist or choose you. Prices are for a pitch delivered to a seller, not for a result.
18. The owner does not compete
PitchToList's owner is a Virginia licensee who is excluded from the agent side of the platform, is never invited, and is bound by the same no off-platform contact rule. See the Terms of Service.
19. Seller information you receive
A shortlisted seller's address, photos and name, and a seller's phone and email once shared or released, are confidential. Use them only to communicate with that seller about listing that home, as section 4 allows. Do not add them to any marketing list, CRM campaign or database for other purposes, sell or share them, or keep them after the seller goes another way except as your brokerage's record keeping rules require. Protect them with reasonable security and follow privacy law.
20. Reports, suspension, removal and appeals
- Sellers can report off-platform contact, false sales, discriminatory content and other problems. We review reports within 2 business days, hear your side, and record every report and outcome.
- We may suspend you during a review if a seller may be harmed. A suspension cancels your open invitations without a strike and charges nothing.
- A confirmed serious breach (for example off-platform contact, a fabricated sale, discrimination, or a lapsed license you did not report) can mean removal. Removal is permanent, forfeits your own unused credits, and bars you from rejoining. Pitches you already submitted are not refunded.
- You may ask us to reconsider a decision within 30 days by writing to legal@pitchtolist.com with anything we should know. We will answer in writing.
- We may report conduct that appears to violate the real estate license law and regulations of your state, or fair housing law, to the appropriate authority.
21. Deleting your account
You can delete your account from your account settings with your password, unless a payment is unpaid or disputed. Your open invitations are cancelled, your submitted pitches stay in sellers' comparisons as from a deleted agent, your license number is kept so a removed agent cannot rejoin, and unused credits end.
