Privacy Policy
Version 2026-11-01.1. Effective November 1, 2026. All legal documents
PitchToList is built so agents learn who a seller is only when the seller decides. This policy explains what we collect, how we use it, who sees it and when, and your rights.
The short version
We collect what we need to run PitchToList. Agents never see a seller's street address, photos or name unless the seller shortlists them, and never see a seller's phone or email unless the seller shares them or chooses that agent. We do not sell personal data, do not share it for targeted advertising, and use no advertising or analytics cookies. You can see, download, correct and delete your data.
1. Who we are
PitchToList LLC, a Virginia limited liability company (mailing address: 8401 Maryland Dr Ste S, Richmond, VA 23294) operates PitchToList and is the controller of the personal data described here. Privacy questions and requests: legal@pitchtolist.com.
This policy covers the website, emails and texts of the Service. It does not cover what an agent or brokerage does with information a seller gives them directly; their own privacy notices apply to that.
2. What we collect
Sellers
- Account: email address, name, mobile number, and the date you confirmed each.
- Your home: street address, unit, city, ZIP, area or neighborhood, property type, beds, baths, size, condition notes, timeline, optional photos, optional notes for agents and an optional private price expectation.
- Verification: the result of our check of your name against county land records, which are public records.
- Activity: your shortlist, messages, choices, pass reasons, follow-up answers, ratings, reports and the outcome you tell us.
Agents
- Account and profile: name, email, mobile number, password (stored only as a one-way hash), headshot, brokerage and, if you add them, its office phone and website, license state and license number, legal name as licensed, service area, full or part time, team.
- Verification: what we found with the licensing board of your license state (name on license, status, expiration, any public disciplinary record) and who checked it; the closed sales you report, the proof you give or that our team looks up from public sources (an MLS report, a link to your Zillow or Homes.com agent profile, or a broker letter) and our check of each sale against MLS or public records.
- Your standing (which bar you clear), worked out from your checked sales.
- Activity: invitations, acceptances, declines and their optional reasons, pitches and commitments, reliability events, strikes, feedback, messages and reports.
- Billing: credit history, pack purchases, per-pitch charges, and from Stripe a customer reference, whether a card is saved, payment status, receipt links and dispute status. Stripe handles your card details; we never see or store your full card number.
Agents our team contacts
When a home is in an area with too few agents on PitchToList, our team may call or email local agents to invite them to join. We find them through public sources such as brokerage websites, and we log each contact: the agent's name, brokerage, the phone number or email we used, the date, the outcome and short notes. Only our team sees this log. It is not linked to any agent account and is never used to decide who is invited. If someone uses the link in one of those emails to stop them, we keep that email address on a do-not-email list so we never send it another one.
Everyone
- Phone verification and texts: your mobile number, the codes we send (stored only as a one-way hash), delivery status, and your consent to receive texts with its date and time.
- Legal records: which versions of our terms and policies you accepted, consents to texts and to saved-card charges, and when, with the IP address and browser type at that moment.
- Usage and device data: IP address, browser and device type, pages requested, the time of each request and error logs, kept by our hosting providers and in our security logs; sign-in history and active sessions.
- Cookies and similar technology: only the strictly necessary ones listed in the Cookie Notice.
- Messages you send our support team, and waitlist sign-ups.
We do not knowingly collect sensitive data such as race, religion, health, sexual orientation, citizenship, biometric or precise geolocation data, and we ask you not to include it in notes, pitches or messages.
3. How we use it
- To run the Service: post homes, invite agents, deliver pitches, open final selection, unlock details on a shortlist, and carry messages.
- To verify people: check seller ownership against county records, check each agent's license and brokerage with the licensing board of their state, check each sale that counts against MLS or public records, confirm emails and phone numbers, and keep agents from posting fake homes.
- To find agents for a home in an area with too few agents on the Service: call or email local agents, keep a log of each contact, and honor requests to stop.
- To bill agents, give credits back automatically, handle refunds and disputes, and keep tax and accounting records.
- To send service emails and texts: sign-in links, verification codes, listing and pitch notices, follow-ups, receipts and notices of changes.
- To keep the Service safe and fair: prevent fraud and abuse, enforce our terms and the off-platform contact rule, handle reports, run rate limits, and keep an audit log of sensitive actions.
- To meet legal duties and to establish, exercise or defend legal claims, including keeping records of what you accepted and consented to.
- To improve the Service using aggregated or de-identified information.
We do not use personal data for targeted advertising, and we do not sell it.
4. How seller details reach agents
| When | What an agent can see |
|---|---|
| Before you shortlist them | The area or neighborhood, property type, beds, baths, size, condition notes, timeline and your notes after names, addresses, phone numbers, emails and links are removed. Never your street address, photos or name. |
| After you shortlist them (up to 3) | Also your street address, photos and name. We record each unlock. |
| If you share your phone in a message | That one agent sees your phone in the message thread. |
| When you choose them | Your phone and email, released to that one agent. The other shortlisted agents are told you went another way and get nothing more. |
Your private price expectation is never shown to any agent. Agents who receive your details must keep them confidential and use them only to talk with you about listing your home (Agent Terms, section 19).
Agents never see other agents' pitches, names, brokerages or photos. An agent who is not shortlisted may get private feedback that says how many pitches the home received and where each of their own commitments placed among them, never another agent's identity or numbers.
Sellers see each pitch as it arrives, on a card labeled with a letter (Agent A onward), with verified license details and reported sales counts but no agent name, brokerage or photo. Once no pitch is outstanding on the home, that is, once all 5 pitches are in, or the home has stopped collecting pitches (the 72 hours after go-live for inviting agents ended, the seller stopped inviting, or no eligible agent was left) and no invited agent is still within their time to answer or their 24 hours to write, the seller sees the name, brokerage and photo of every agent who pitched, shortlisted or not. After shortlisting an agent, the seller can also open that agent's full pitch, which includes their license number and, if the agent added it, their brokerage's office phone or website.
6. No sale, no targeted advertising
We do not sell personal data, and we do not share or process it for targeted advertising or cross-context behavioral advertising, as those terms are defined in the Virginia Consumer Data Protection Act (VCDPA), the California Consumer Privacy Act and similar state laws. We do not use advertising pixels, ad networks or data brokers, and we do not give lenders, advertisers or lead buyers any user's data.
Because we do not sell or share for advertising, there is nothing to opt out of; we still treat a Global Privacy Control signal as a request to opt out.
Text messages
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except the SMS provider that delivers our messages. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes. See the SMS Terms.
Message frequency varies. Msg and data rates may apply. Reply STOP to opt out, HELP for help.
8. How long we keep it
| Data | How long |
|---|---|
| Seller account, homes, photos, notes and messages | While the account is open. When you delete it, your name, email, phone, addresses, photos, private notes and price, and the text of your messages are removed at once; a placeholder row stays so agents' credit and pitch records add up. |
| Agent account, profile, pitches and reliability records | While the account is open, then up to 7 years after it closes for billing, dispute and audit records. The license number is kept after deletion so a removed agent cannot rejoin. |
| License checks, closed sales and proof | While the account is open and up to 7 years after, as the record of verification. Uploaded proof files (MLS reports and broker letters) are deleted 7 years after we receive them, or sooner when the account is deleted. |
| Payment and credit records | 7 years, for tax and accounting. |
| Acceptance and consent records (terms, texts, saved cards) | While the account exists and 7 years after, as evidence of consent. These records are kept even after a seller deletes their account. |
| Email and text logs | Up to 2 years; removed for a seller who deletes their account. |
| Sign-in links and texted codes | They expire within minutes and are deleted when an account is deleted. |
| Security and audit logs | Up to 7 years for actions such as unlocking an address or removing an agent; hosting request logs for up to 30 days. |
| Recruiting call log (agents our team contacted) | Kept with the record of the home the contact was about. |
| Do-not-email list (people who stopped our recruiting emails) | For as long as we send recruiting emails, so the request keeps being honored. |
| Waitlist sign-ups | Until we open in your area or you ask us to remove you. |
We may keep data longer if the law requires it or while it is needed for an open dispute, investigation or legal claim, and we may keep de-identified or aggregated data that no longer identifies anyone.
9. Security
We protect data with encryption in transit (HTTPS), hashed passwords and codes, signed session cookies, access controls and audit logs for operators, rate limits, and providers with strong security programs. No system is perfectly secure. If a breach affects your personal data, we will notify you and regulators as the law requires.
10. Your rights and choices
Wherever you live, and as required by the Virginia Consumer Data Protection Act (VCDPA) and similar state laws, you may:
- confirm whether we process your personal data and get access to it;
- correct inaccurate personal data;
- delete personal data you gave us or we hold about you;
- get a portable copy of the data you gave us;
- opt out of the sale of personal data, targeted advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects (we do none of these, but you may still ask); and
- not be discriminated against for using these rights.
How to use them
- Sellers can change their name and phone, download their data and delete their account from the account page.
- Agents can update their profile and delete their account from account settings.
- Anyone can email legal@pitchtolist.com from the email on their account. An authorized agent may make a request for you with your signed permission; we may ask you to confirm your identity first.
We answer within 45 days. If we need more time (up to 45 more days) we will tell you why within the first 45. Requests are free up to twice a year. Some data we must keep, such as payment records and consent records, and we will tell you what we kept and why.
Appeals
If we decline your request, you may appeal by replying to our answer or writing to legal@pitchtolist.com with "Privacy appeal" in the subject within 60 days. We will respond in writing within 60 days and explain our decision. If we deny the appeal, you can contact your state's attorney general to submit a complaint (in Virginia, the Virginia Office of the Attorney General).
Automated decisions
Choosing which eligible agents are invited to a home is automated. It uses only each agent's license state, service area, property preferences, availability, reliability record on PitchToList, who recently competed with whom, and the agent's closed sales checked against MLS or public records (to apply the published bars), never payment, brokerage or any personal characteristic. Agents can see their own reliability record and can contact us to question an entry. Sellers are not profiled.
11. Children
PitchToList is for adults. We do not knowingly collect personal data from anyone under 18. If you believe a child gave us personal data, write to legal@pitchtolist.com and we will delete it.
12. Where data is processed
The Service is for people in the United States, and data is processed in the United States.
13. Changes to this policy
We will post any change here with a new version and date. If a change is material, we will tell you by email and on the Service before it takes effect, and ask signed-in users to accept the new version. We will not use personal data in a materially different way than this policy describes without your consent.
